The following terms of use apply to all users of MY YOOJI‘S. They govern the relationship between the user of MY YOOJI‘S and Two Spice AG.
MY YOOJI‘S
MY YOOJI‘S is an advantage programme available to anyone interested in finding out more about Two Spice AG (hereinafter referred to as „Yooji‘s“) and offers from Yooji‘s. Users of MY YOOJI‘S (hereinafter referred to as „users“) primarily benefit from special offers and services such as discounts and simplified payment processes in connection with consuming food/beverages, orders and purchases in Yooji‘s restaurants and stores.
Yooji‘s coins and Yooji‘s vouchers
With every payment in Yooji‘s restaurants and stores in Switzerland, the MY YOOJI‘S user collects Yooji‘s coins (hereinafter referred to as „coins“), which are credited to their MY YOOJI‘S account (hereinafter referred to as „account“).
The user receives 10 coins per CHF 1 of goods purchased and/or food/beverages consumed. When the user reaches 2,000 coins, they receive a Yooji‘s voucher (hereinafter referred to as „voucher“) for the value of CHF 5 in digital form credited to their account. A voucher may be applied to the next payment in Yooji‘s restaurants and stores or the user may invest their 2,000 coins in a current fundraising campaign selected by Yooji‘s. The donation amount corresponds to the value of the voucher. The user can decide whether to donate their coins or redeem a voucher worth CHF 5 within 72 hours of reaching 2,000 coins by making the appropriate selection in their MY YOOJI‘S account. If the user does not make a selection within 72 hours, the voucher worth CHF 5 will be automatically credited to their account.
If the user has donated coins, they will receive a confirmation of donation by email. However, this cannot be used as a charitable donation certificate for the tax authorities.
The coins and vouchers will not be paid out in cash. The resale of coins and vouchers is prohibited and may lead to the MY YOOJI‘S account being blocked. However, giving away vouchers is permitted.
Account setup and payment method
An authorized account at www.yoojis.com is required to enjoy all of the benefits of MY YOOJI’S. To set up a personal account, MY YOOJI’S users are required to log in using a verified email address and Yooji‘s Card users are required to log in using a personal, eight-character, alphanumeric code as well as a verified email address. A maximum of CHF 1,000 can be transferred to a MY YOOJI‘S account by purchasing prepaid credit. Yooji‘s will not be held liable for transfer errors and technical faults. Credit card or the prepaid credit in a MY YOOJI‘S account are accepted as a payment method in all Swiss Yooji‘s restaurants and stores.
The prepaid credit stored in an account is solely an advance payment for goods and services offered by Swiss Yooji‘s restaurants and stores and can only be used to pay for these goods and services in Swiss Yooji‘s restaurants and stores as well as for Yooji‘s online orders in Switzerland. MY YOOJI‘S can also be used without storing any payment methods.
Viewing current benefits
Users do not receive account statements for individual transactions. The number of collected coins, vouchers, the prepaid credit balance and ongoing promotions can be viewed in the account.
Fees
Participation in MY YOOJI‘S is free. In addition, fees are not charged for any transaction processes such as credit card or prepaid deductions.
Validity
The vouchers are valid for 12 months from the date of issue and then automatically expire without corresponding notification. The prepaid credit expires five years after advance payment if it was never used during this time. A MY YOOJI‘S account which has not been interacted with for five years will be deactivated. This process will result in the expiry of any prepaid credit and any previously collected coins and vouchers with no option of a cash payout.
Data privacy and communication
The personal information provided when registering for MY YOOJI‘S (email address, first and last name, postal address, correspondence language, mobile telephone number, date of birth, employer) are processed for the implementation of MY YOOJI‘S. In addition, Yooji‘s uses names, email addresses and telephone numbers to send emails or push notifications containing personalized offers from Yooji‘s, as long as the receipt of such information has not been deactivated. Furthermore, Yooji‘s uses data about frequency, location, amounts and products in purchases made by MY YOOJI‘S guests for customer service and marketing purposes. Handling complaints
Yooji‘s reserves the right to adjust a user‘s points balance if there is a typing, accounting or booking error. The contact form in the MY YOOJI‘S account can be used for user complaints. Once the complaint has been received, Yooji‘s will check the transactions and correct any errors. Yooji‘s assumes no responsibility for booking errors.
Furthermore, Yooji‘s is not liable for technical problems and associated disruptions when transferring coins and redeeming vouchers.
Liability for unauthorized transactions and availability
Storage of the Yooji‘s Card and handling of the personal MY YOOJI‘S login data is the full responsibility and duty of care of the owner. In principle, the person who owns a Yooji‘s Card or has a MY YOOJI‘S account is entitled
to make payments across the entirety of Yooji‘s range. Yooji‘s only reserves the right to not accept a payment using a credit card or prepaid credit or to otherwise restrict the use of an account if the use is unauthorized, fraudulent or otherwise unlawful.
The contact form can be used to block a MY YOOJI‘S account. Processing of incoming messages does not take place 7 days a week and 24 hours a day. Yooji‘s accepts no liability whatsoever for damage as a result of the loss or misuse of the Yooji‘s Card. The prepaid credit and payments with the credit card in an account are not insured or guaranteed by Yooji‘s in the event of theft or loss.
In cases of force majeure and/or technical failure, Yooji‘s may temporarily suspend the crediting of coins. This does not give rise to any claims for damages against Yooji‘s.
Yooji‘s accepts no liability for the constant availability of MY YOOJI‘S.
Deactivating a MY YOOJI‘S account
A MY YOOJI‘S account can be deactivated by sending a message via the contact form. This process will result in the expiry of existing prepaid credit, Yooji‘s coins and Yooji‘s vouchers with no option of a cash payout.
Amendments to the terms of use
Yooji‘s reserves the right to make amendments to these terms of use or to any guideline, FAQ or instructions relating to MY YOOJI‘S at any time and at its own discretion. All amendments to these terms of use will be published online at www.yoojis.com.
An amendment will be deemed to have been accepted by the user and will be effective if the user continues to use MY YOOJI‘S.
Registered users will be notified of all amendments, additions and deletions by email.
Applicable law and jurisdiction
These terms of use shall be governed by Swiss law. The exclusive place of jurisdiction is Zurich, Switzerland.
Interpretation
Should any provision in this agreement be declared unlawful or unenforceable, this shall not affect the remaining provisions. The parties undertake to replace any invalid or unenforceable provision with a valid or enforceable provision which reflects as closely as possible the commercial purpose of the invalid or unenforceable provision. The same applies in the event of a loophole in the provisions.
